- The Apple Sanity webmaster, our associates, and all other affiliates do not advocate, condone, or suggest the use, abuse, possession, or distribution of any controlled substance or medication, including (but not limited to): marijuana, psychotropic mushrooms, amphetamines and amphetamine-derived substances, Phenobarbital, Dextromorphan (DXM), anti-depressants, and opiates and opiate-derived prescription pain-killers.
PRIVACY POLICY
- Any input or information from users or parties sent directly to the applesanity domain, its administrators, or its affiliates, become property of Apple Sanity, Sunshine Ecstasy, Inc. However, UNLESS THE USER OR PARTY GIVES EXPLICIT INSTRUCTIONS AND/OR PERMISSION STATING OTHERWISE, Apple Sanity, Sunshine Ecstasy, Inc. will neither publish nor divulge to a third party any personal information sent to the applesanity.com domain. For demonstrative purposes, an email that contains the sentence, “track me down and write shit about me- I don't fucking care. cunt” counts as permission for the Apple Sanity webmaster to publish and divulge information regarding the user who wrote said statement. Those of us who control Apple Sanity reserve the right to interpret the content of any email or comment as permission for releasing information of the sender if the implications for such permission are plainly obvious. It is the obligation and responsibility of the user or party writing any emails and/or comments to be mindful of context, in order to prevent misinterpretation. Nevertheless, webmaster reserves full rights to publish or divulge any emails or comments sent directly, indirectly, or addressed to, the applesanity domain, its administrators, or its affiliates. However, when such emails are published, the 'from' and 'to' addresses will not be displayed in its entirety for the sake of privacy. All users and parties attempting to do the aforementioned will do so at their own risk. Furthermore, Applesanity.com, its subpages, scripting, coding, and subdomains, and all other material relating to its online content are expressly protected by the the European Union Copyright Directive (EUCD) of 2001, which provides similar protection as the DMCA. Hence or otherwise, any and all end users or parties must understand that by stating 'exclusive property' or 'copyright' of applesanity.com, the content within this domain is protected by patent law, copyright law, trademark law, and any and all proprietary rights in effect now or hereafter worldwide. It is imperative that any and all users and parties must familiarize themselves with the provisions of the DMCA and EUCD before accessing the online content of Applesanity.com or any other digital media or material henceforth.
BASIC SERVICES AGREEMENT
- For a fee as specified on the services page users and/or parties will be granted a subscription to 'Apple Sanity Basic Services' and provided with a login name and respective password in order to access restricted content on subdomains that require authorization. Any and all content on these subdomains are subject to the terms and conditions of the Apple Sanity Disclaimer Policy. Under no such conditions or circumstances are these login names and passwords allowed for distribution to any and all non-subscribers or other subscribers.
PREMIUM SERVICES AGREEMENT
- In addition to all rights granted to users or parties, who have subscribed to the Apple Sanity Basic Services, users who have followed the procedures for premium services, as outlined on the services page, are granted a premium account. Subscribers to the 'Apple Sanity Premium Services' account are granted ftp access to a subdomain with a name of their choosing. Under a premium ftp account, users are granted 50 Mb of online storage to host a website under the the Apple Sanity domain. Such websites are subject the Apple Sanity Disclaimer Policy and any applicable copyright laws. Under no condition or circumstances shall these online storage contain material that adult, criminal, treasonous, or 'hate' in nature, nor shall their content infringe upon copyright laws. Material or content is considered as 'hate' if it advocates violent or nonviolent defamation or advocacy against any race, religion, nationality, ethnicity, or creed. At any time, for any or no reason, and without notice, the Apple Sanity may review such content and subject the content to censorship. For all practical purposes, the online storage space is granted total freedom in all areas under the basic 'don't do anything I wouldn't do' maxim; hence or otherwise, that do not infringe on any governmental laws in existence and do not present legal concern.
INDEMNIFICATION
- All end users and parties will and must indemnify, defend, and hold Apple Sanity, Sunshine Ecstasy, Inc. not liable and free from any third party lawsuit or legal action brought against www.applesanity.com based upon any and all claims that would constitute a breach of any and all terms of the Apple Sanity Disclaimer Policy between any and all end users and parties, including but not limited to any third party lawsuit or any legal action otherwise, brought against Apple Sanity, Sunshine Ecstasy, Inc. based upon claims that the content, images, coding, and/or otherwise, any material or text presented by www.applesanity.com infringe(s) any copyright or trademark of the third party. This indemnification will include 1) all attorneys' fees and costs associated with the defense of such a claim, and 2) the award of any damages, settlements, and costs.
INFRINGEMENT OF DISCLAIMER
- Any and all infringements of the Apple Sanity Disclaimer Policy shall be dealt with in accordance to the regulations and provisions of United States and international laws. Those of us who control Applesanity will aggressively and actively seek prosecution of any and all offending users and/or parties to the utmost extent of legal means.
CONDITIONS OF DISCLAIMER
- Any and all terms and conditions not expressly stated in this Disclaimer Policy are to be interpreted and/or dictated only by those of us who control Apple Sanity and by no other user, party, or attorney. The terms and conditions of this Disclaimer Policy are non-negotiable and may not be subject to review. Webmaster and associates reserve full and total rights to change this Disclaimer Policy at any time and without notice. The obligation to stay updated and informed on any changes to the Apple Sanity Disclaimer Policy is the express obligation and burden of the user or party.
